BY COMMISSIONING ME, YOU AGREE TO AND UNDERSTAND THE FOLLOWING:

Please read the following page carefully. When requesting a commission, you will be required to acknowledge that you have read this page in full. By purchasing my services and art, you automatically agree to the terms and conditions of service outlined below. If you are not comfortable/willing to accept these terms, you may not request a commission. Any attempt to violate these rules will result in an indefinite blacklisting of services.

✦ GENERAL TIMELINE

I do my very best to complete work as soon and timely as possible, though I also juggle a number of other things in order to financially support myself which may cause slow downs.

You can always refer to my trello board for general updates in between direct check-ins!

✦ TRELLO BOARD

My trello board serves to make up for what I may lack in communication, to easily give out a scope of progress and to ensure that while time may pass, commissions are not forgotten! This way, commissioners don't have to be stuck wondering about delays that may happen, as well as for those who may have anxieties about asking for updates.

✦ You can also view the info, status, and progress of your commission via your card.
✦ Though it's done manually, I do my best to update the cards as soon as possible, whenever possible.
✦ If your commission is on this board, however long it may be, I promise that it is not forgotten!

✦ DEADLINE + RUSH FEES

✦ By default, there is no set deadline unless the client provides a reasonable and meaningful deadline (e.g. a birthday gift, holiday piece, etc).

✦ Other reasons may or may not be accepted and may be subject to a rush fee depending on the timescale, especially if you must be bumped up the queue in front of others.

✦ Rush fees are at least +25% of the commission, but may also depend on the project and timeframe provided.

✦ Typically, deadlines that are after 2 months of starting won't incur any fee (depending on the project).

✦ I may or may not be able to accept certain requests with a deadline if I feel that I cannot adequately fulfill it.

✦ ADDITIONAL CHARACTERS

✦ Additional characters are added as if commissioning another character, and are separately calculated in terms of complexity/etc. costs.
✦ Things such as backgrounds wouldn't need to be doubled. These are considered a separate pricing factor from the character(s).

✦ PRICES AND FEES

All prices are in USD and invoices will be sent when a price is confirmed, or if the final quote matches the form estimate.
Please ensure that you have the funds to pay if you are requesting a commission.
However, if emergencies happen afterwards, I understand! Just let me know!

PAYMENT PLANS + INFO

If the commission is...
$100 and under: clients must pay the total in full.
over $100: clients may choose to either pay in full or half upfront.
over $500: clients may choose to either pay in full or in multiple large installments that fit the total price.(ie. paying in increments of $10 or $20+ for a commission that's total price is $100, vs paying in increments of $5).
Despite this however, I can still be flexible about payment plans depending.

LATER PAYMENTS + FEES

Additional payments may be made later due to:

✦ Revision fees for significant and/or excessive requests

I price my work based on demand, livable wage, and the amount of time and effort it takes to finish in accordance to my skill, experience, and quality. Haggling or insisting on discounts is unacceptable and will result in blacklisting.

As a quick side note, I may be open to being paid in Nintendo Eshop/Steam Gift cards, however this'll be done case by case.

✦ REFERENCES

✦ Visual references are required. Google Drive, Toyhou.se, Dropbox, etc. links work perfectly! If a reference repository has more than one look/outfit/appearance/etc., make sure to specify which you want (or if it's artist's choice).
✦ If you would like specific poses or moods, you may also share relevant images you have or create yourself (no matter how scribbly or messy it is, I absolutely don't judge- even stick people work well for this)!
✦ Mood boards, inspiration boards, and written descriptions that accompany visual references are more than welcome! Vibes are very important to me and I love reflecting a character or scene's essence whenever I possibly can.
✦ If unable to decide between ideas or characters, you may pitch several to choose from! Obviously only one will be accepted (and any others are more than welcome to be requested in the future). Make sure to indicate that you're offering several ideas as choices to avoid confusion.
✦ Though I can work off description alone, some level of visual aide is helpful.

✦ ARTISTIC FREEDOM

✦ Note that I will retain some level of artistic freedom: as artist and client, a commission creates a partnership and not an employment.
✦ I will not carry out something that is far too removed from my aesthetics just because I am an artist. I will not be used to execute arbitrarily difficult ideas or demands, and have the right to decline a commission for any reason if I feel uncomfortable or inadequate at my current level of skill.

While I will certainly do my best, if what you want is beyond my capability to execute or far too different from what I usually do, you may be better off seeking someone who better fits your vision.

✦ COPYRIGHT

✦ I fully own the works I create and reserve the right to sign/watermark my work, as well as to publish, post, and display in my portfolio.
✦ Clients receive full resolution, though still watermarked file.
✦ Intellectual properties I do not own (such as characters, concepts, designs, etc. that I did not make) belong to their respective owners.

✦ PRIVACY

✦ Works in Progress (WIPs) are shared with Ko-fi members and occasionally in public in the form of previews and snippets.
✦ WIPs that you receive may be shared among others in private spaces (such as among friends, discord, twt circles/locked twts, etc.)
✦ If a commission and/or its process is desired to be made private (not uploading WIPs or the final piece anywhere, whether on social media or my website), a Non-Disclosure Agreement (NDA) fee must be paid, and is an additional 20% of the commission's price (15% if requested to be under an NDA until a later date).

✦ SUPPORTER CONTENT

✦ Your commission may be used for process GIFs and WIP sharing for supporters ( Ko-fi members and Discord boosters ).
✦ In this case, regardless of whether or not you are a supporter, you will receive any byproduct made of your commission.
✦ You may also indicate if you would not like these to be made when requesting a commission.
✦ I cannot guarantee these will be made, but it's a heads-up nonetheless.

✦ GENERAL USAGE

✦ If the client has not paid for the rights for explicit commercial use, the commission is considered to be of personal use.
✦ Under personal use, the client may create and print for themselves or others to have or give as a gift, but absolutely no profit is to be made through any part of the commission work. (Basically, printing on products for yourself or others is fine, as long as you are not selling for profit!) More information on commercial usage can be found below.

The commission is free for the client to non-commercially use however they like, given that:
✧ Explicit credit to the artist (CrystalChimera) remains,
✧ The work is not claimed as the client’s own work,
✧ Absolutely no profit is to be made from the work in any way.

✦ COMMERICAL USAGE

✦ Commissions can cost x2-x3 of the original price, depending on the scope of its commercial use- for example, producing merchandise would be more than using in a stream, etc.

Commercial use may be defined as follows, but are not comprehensive and may be added to at any point in time.
✧ Reproducing and selling the artwork.
✧ Merchandising.
✧ Usage in branding, promotional material, content, and websites.
✧ Usage within mediums/platforms where the client receives profit (eg. Patreon, Twitch, YouTube, etc.)

✧ If you are caught using my work commercially without this permission, you will be issued a warning. If this warning is not heeded, you will be blacklisted.

✦ NON FUNGIBLE TOKENS / CRYPTO CURRENCY / A I

Clients are not permitted, under any circumstances, to use any part of their commission for AI image generations/training and non fungible tokens (NFTs). Use of my artwork for any advertising or profits associated with AI generated images, non fungible tokens, and cryptocurrency is strictly prohibited. I also do not accept cryptocurrency as payment.

Note that I will never sell/resell any of my work whatsoever as non fungible tokens. If my work is found listed as a non fungible token or resold for cryptocurrency, it is not permitted and is stolen or a direct violation of my terms.

✦ CANCELLATION

✦ I have the right to cancel a commission at any time for any reason.
✦ Similarly, the client may also cancel in the same manner.
✦ However, the refund given will be proportionate to the amount of work not completed.
✦ The unfinished commission along with other relevant material produced along with it will be given to the commissioner upon cancellation.
✦ Abusive behavior towards me will result in cancellation of the commission, potentially without refund in the most extreme cases.
✦ Refunds may take time depending on whether I have the current funds or not, since I may need to pay important bills and may not have savings because. This will be clearly communicated.

✦ REFUNDS

If for any reason the commission cannot be completed or the client cancels, the client will be issued a refund depending on what has been finished. The refund must be confirmed by the client within 60 days, and the client will still receive whatever assets are done.

✧ Not started — 100% Refund
✧ 25% complete — 75% Refund
✧ 50% complete — 50% Refund
✧ 75% complete — 25% Refund
✧ Finished — No Refund

✧ If you still owe future invoices due to partial payment and would like to pause your commission's progress due to situations such as financial hardship, please let me know! I will be more than happy to put the project on hold to continue on later if you would still like it to be finished. I totally understand, pay your important stuff/bills first, I can wait!

✦ CHARGEBACKS

✦ Chargebacks will result in a permanent ban from future commissions.
✦ This is considered a method of abuse and exploitation, most commonly used as such, and will not be tolerated.
✧ If you would like to request a cancellation or refund, please contact me!
